ARTICLE 38: PARTY LISTS
38.1. Pursuant to and in accordance with Article 90 of the Constitution of Kenya, the
party shall submit to the Independent Electoral and Boundaries Commission Party
lists containing:
(a) Twelve persons for consideration as nominated Members of National Assembly to
represent special interests including the youth, persons with disabilities and
workers
(b) Sixteen women for consideration as nominated Members of the Senate:
(c) Two members, being one man and one woman for consideration as nominated
members of Senate representing the youth:
(d) Two members, being one man and one woman for consideration as nominated
members of the Senate representing persons living with disabilities.
38.2. The Party lists referred to in, Clause 1 (a) shall alternate between male and female
candidates in the priority in which they are listed, and shall reflect the regional and
ethnic diversity of the people of Kenya.
38.3. In drawing the party lists, the Nationals Elections Board shall receive and process
applications from party members who are qualified to be on the party lists.
38.4. The applications contemplated’ in clause (3) above shall

38.6. The Party list for Special Seats in all the County Assemblies shall be drawn by the
National Elections Board in the same method as the lists for nominated Members of
