(vi) Acting or advancing positions in contrary to the party position;
(vii) Failure, refusal or neglect to carry out directives or instructions of the Party;
(viii) Failure to make remittance / or pay dues to the Party;
(ix) Lack of respect to decisions of the party and the organs of the Party;
(x) Failure to abide by the Code of Conduct of the Party;
(xi) Any other act or omission that may bring the party into disrepute;
(b) The National Chairperson may in consultation with the National Executive Committee,
appoint a Commission to investigate the affairs of any County, Constituency, Ward,
Polling Station Executive Committees or organ of the party.
(c) The National Chairperson may refer any disciplinary matter to any disciplinary organ
established under this constitution.
(d) The National Chairperson may act on any recommendations made by the commission and
any action or decision taken by them in pursuance of the said recommendations shall be
valid unless and until such time as the National Executive Council may ratify or set
aside, or substitute the same.
34.4. Penalties for Disciplinary Measures
(a) In the discharge of its disciplinary mandate the National Executive Council may:
(i) Suspend a member;
(ii) Expel a member;
(iii) Fine a member;
(iv) Remove the whip from a member of committees of Parliament or County
Assemblies;
(v) Set aside a decision
(vi) Review its own decision
(vii) Substitute or uphold penalty imposed by any disciplinary organ
(b) The decision of the NEC shall stand notwithstanding any right of appeal subject only to
Clause 15. 2.The decision of the National Executive Council shall be final.
