33.4. The Tribunal have powers to  adjudicate  and determine over disputes arising out  of or
                    relating to the outcome or the conduct of any nominations and/or elections within the Party

                    or any matter connected therewith and any or an aggrieved member shall refer the same to
                    the Elections Appeals Tribunal established under this Article.

               33.5. The Tribunal shall make rules to govern procedures and conduct of its affair under this

                    Article  and  such  rules  and  procedures  shall  be  ratified  by  the  National  Executive
                    Council.

               33.6. The verdict of the Tribunal on any matter before it shall be final and shall not be the subject
                    of review by another organ of the Party.


               33.7.A party who is aggrieved by a decision of the tribunal may lodge a complaint to the National

                    Elections Appeals Tribunal which shall hear and determine such complaints. The decision
                    from the National Elections Appeals Tribunal in respect thereto shall be final.




               ARTICLE 34: NATIONAL DISCIPLINARY COMMITTEE

               34.1. There shall be established a KANU National Disciplinary Committee.

                    (a) The National Disciplinary Committee shall be composed of not less than three (3) and
                       not more than seven (7) members including the chairperson AND which membership

                       shall be determined from time to time by the National Chairperson in consultation with
                       the  National  Executive  Council  PROVIDED  not  more  than  two  thirds  of  the

                       Membership shall be of same gender.

                    (b) The Chairperson of the National Disciplinary Committee shall be appointed by the
                       National Chairperson in consultation with the National Executive Council.


                    (c) The Chairperson of the National Disciplinary Committee shall be a person who is

                       qualified to be a judge of the High Court of Kenya and who is in compliance with
                       Chapter Six of the Constitution of Kenya.

                    (d) The National Disciplinary Committee shall have both original and appellate jurisdictions

                       to hear and determine matters relating to or concerning discipline within the party.

                    (e) The Members of the National Disciplinary Committee shall be appointed by the National

                       Executive Council from among persons who are:

                           (i)  Citizens of Kenya of above the age of 18 years

                           (ii) Reputable, knowledgeable competent and impartial
