7.3. The person assuming the office of the Party National Chairperson shall before taking up
office take and subscribe to the oath of allegiance to the Party and such oath of due
execution of his office as may be prescribed by the National Governing Council.
7.4. Term of office:
(a) The Party National Chairperson shall, unless his office becomes vacant by reason of
his death and subject to the provisions of clause 6 of Article 5 continue in office until
the person elected as the next National Chairperson at a National Delegates
Conference assumes office;
(b) If the office of the National Chairperson becomes vacant for any reason anticipated
under this Article, the First National Deputy Chairperson shall exercise the functions
of the office of the National Chairperson. Where both the office of National
Chairperson and the National First Deputy Chairperson are vacant, the Second
National Deputy Chairperson shall exercise the functions of the National Chairperson
subject to clause (d) of this Clause;
(c) Where the offices of National Chairperson, First National Deputy Chairperson and
Second National Deputy Chairperson fall vacant at the same time, the Secretary
General in consultation with the National Executive Council shall convene within 14
days a special National Governing Council to nominate amongst its members a
candidate to fill the position of the National Chairperson;
(d) The National Governing Council shall convene within three months of the office of
National Chairperson falling vacant to elect a person from amongst its members to
serve as the National Chairperson for the remaining term of the immediate former
National Chairperson. Where the office of National Chairperson falls vacant
less than six months to the general election, the First National Deputy Chairperson
shall act as Chairperson until the National Governing Council meets after the next
National Delegates Conference.
7.5. The office of National Chairperson shall become vacant if:
(a) The holder of the office dies in office;
(b) The holder of the office resigns by writing to the National Executive Council; or
(c) Circumstances arise that would disqualify him from holding a State Office in
accordance with the Constitution of Kenya.
